The Americans with Disabilities Act was signed into law on July 26, 1990.

 

Question Two
Mr. Jones owns a four unit building.  He lives in one unit and rented the three remaining units to male tenants.  These three units are always rented to male applicants because Mr. Jones believes he can rent the units to anyone he wants to.  Mr. Jones renting these units to only men is an example of:

Answer: B.
The “Mrs. Murphy” exemption provides that if a dwelling has four or fewer rental units and the owner lives in one of those units, that home is exempt from the HFA. “Mrs. Murphy” is the hypothetical elderly widow who has converted a portion of her home into a rental apartment to supplement her limited income. It’s important to know while Mr. Jones is referring to Mrs. Murphy’s exemption, this does not mean he can discriminate while advertising his units.

A project consists of two buildings, with an MSA of Average Income selected on the 8609 and all are part of a multiple building project. Both buildings have five units each, 10 units total. The owner has chosen to have three units at 80%, four units at 60%, two units at 40% and one unit at 20% - Total: 580%. This minimum set aside is a 40/60 average. At a minimum, how many units must be affordable?

Answer: A. 4
Multiply the total number of units, 10 by 40% which represents the minimum percentage of units that must be LIHTC at all times. 10 X 40% = 4 units that must be affordable.
